Unfair Labor Practice Charge Form
Overview: The New York State Public Employment Relations Board (PERB) adjudicates alleged violations of the State Employment Relations Act (SERA), as amended by the Farm Laborers’ Fair Labor Practices Act (FLFLPA).
Before you File:
- Review the portions of the SERA, as amended by the FLFLPA, and PERB’s corresponding Rules of Procedure related to unfair labor practices.
- See Sections 704, 704-a, and 704-b of the SERA.
- See also Sections 252.1 to 252.5 of the Rules of Procedure for private sector, non-agricultural employers.
- See Sections 263.34 to 263.39 of the Rules of Procedure for agricultural employers and employee organizations.
- If you are an individual representing yourself, review PERB’s Guide for Parties Representing Themselves Under the SERA.
How to File:
- Complete all pages of the Unfair Labor Practice Charge form below.
- File the form:
- by email to [email protected].
- by mail to NYS Public Employment Relations Board, PO Box 2074, ESP Agency Building 2, Floor 18, Albany, NY 12220-0074.
- or by fax to (518) 457-2664.
- Once the unfair labor practice charge is filed and deemed sufficient, you will receive a Notice of Conference letter that includes the case number.
