ALFRED GRONER d/b/a TWENTY TWO FORTY ASSOCIATES, OWNER AND SDG MANAGEMENT CORP., AGENT AND SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 32E, AFL-CIO SERB certified SEIU 32E, AFL-CIO as the representative a one-person unit following a hearing during which the sole employee in the unit testified that he wanted such representation. One month later, the employer filed a motion for reconsideration of the certification based upon a document purportedly signed by the employee stating he did not want to be represented. SERB denied the employer’s motion stating that the best means for determining employee choice is through a secret ballot election or through a hearing in the case of a one-person unit. In this case, the employer failed to participate in the hearing which led to the certification although it was on notice of the hearing. In denying the motion, SERB stated: “Allowing certifications to be set aside because employees have purportedly changed their mind would destabilize the bargaining process in an unacceptable way and would potentially expose bargaining unit members to constant pressure to abandon their actual desires.” (50 SERB 4, Case No. SE-59005, 2/12/96)
210 EAST BROADWAY OWNERS CORP., OWNER AND CASSIS MANAGEMENT CORP., AGENT AND LOCAL 32B-32J, SERVICE EMPLOYEES INTERNATIONAL UNION, AFL-CIO A motion to add the managing agent to the caption of representation petition was granted. The managing agent was on notice of the petition, was served with a copy of the hearing notice, participated in the hearing and made post-hearing submissions. In its decision, SERB held that the building owner and managing agent were joint employers under SERA noting that “[i]t is our practice in building service cases to find building owners and their agents to be joint employers.” (50 SERB 9, Case No. SE-59013, 3/27/96)
NAPLES EQUITIES L.P., OWNER AND METRO U.S. MGMT. CORP., AGENT AND SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 32E, AFL-CIO The employer declined to stipulate that a one-person unit was appropriate. In its decision, SERB held that one-person units were appropriate and noted that such units had been found appropriate for over fifty-years both by itself and its predecessor, the Labor Relations Board with the courts’ approval. BEAUCHAMP GARDEN OWNERS CORP. AND SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 32E, AFL-CIO SERB accepted the recommendations and adopted the opinion in the intermediate report of the Administrative Law Judge (ALJ) concluding that the employer had not unlawfully discharged a building superintendent for engaging in union activity in order to defeat unionization in violation of §§704.4 and 704.5 of the State Employment Relations Act (Act); and concluding that the employer had not engaged in an unfair labor practice in violation of §704(6) of the Act by failing or refusing to commence negotiations with the union. The evidence demonstrated that the employee had been notified of his discharge prior to joining the union and that the effective date of his discharge was prior to the employer’s receipt of the bargaining demand. NICK & MARINOS DINER LTD. OPERATING MUNSON DINER AND H.E.R.E., LOCAL 100, AFL-CIO SERB accepted the recommendations and adopted the opinion in the intermediate report of the Administrative Law Judge (ALJ) concluding that the employer had failed and refused to bargain with the union in violation of §704.6 of the State Employment Relations Act (Act. The evidence established that the employer had utilized numerous excuses to avoid meeting to negotiate, demonstrating a clear intent to avoid the bargaining requirements of the Act. OPTIONS FOR INDEPENDENCE, INC. AND OPTIONS FOR INDEPENDENCE STAFF ASSOCIATION, LOCAL 2300, UAW Prior to the election, the union sought a unit consisting of all full time and regular part time employees while the employer sought to exclude the accounting manager and the administrative assistant on the grounds that they were both confidential employees. The union disputed the employer’s factual basis for these claims. The subsequent election was held with the “confidential” and non-confidential employees placed in separate units. A majority in the non-confidential unit voted in favor of representation while the votes of the “confidential” unit were challenged by the employer. However, no objections to the election were filed. The employer also argued that since one of the “confidential” positions was abolished after the election, the remaining one person unit was in appropriate for certification. In its decision, SERB held that confidential employees are covered by SERA and that one person units have consistently found appropriate. SERB certified the union as the representative of the non-confidential unit employees and directed that the challenged ballots of the alleged confidential employees be counted. 250 WEST 43RD STREET PARKING INC. AND GARAGE EMPLOYEES UNION LOCAL NO. 272 IBT The union filed a petition concerning a question of representation and SERB found that Garage Employees Union Local No 272, IBT was not the exclusive representative of a two person unit consisting of the garage service employees in the parking garage at 250 West 43rd Street, New York, New York following a secret ballot election. OPTIONS FOR INDEPENDENCE, INC AND OPTIONS FOR INDEPENDENCE STAFF ASSOCIATION, LOCAL 2300, UAW SERB found the appropriate bargaining units in this case to be (1) a unit consisting of all full-time and regular part time employees (excluding the executive director, administrative assistant, and accounting manager) and; (2) a unit consisting of the administrative assistant and accounting manager. Following the election, SERB overruled the challenged ballots of the employees in the second unit and after counting the ballots, found both were cast in favor of representation. SERB therefore certified Options for Independence Staff Association, Local 2300, UAW as the exclusive representative of the employees in the second unit. (50 SERB 34, Case No. SE-59162, 12/12/96)
OGDEN HJR CORP., OWNER AND RUTH MANAGEMENT L.L.C., AGENT AND SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 32E, AFL-CIO, PETITIONER AND FACTORY AND BUILDING EMPLOYEES UNION, LOCAL 187, INTERVENOR SERB found that the record was unclear as to whether a purported contract between the Intervenor and the employer was executed prior to the employer’s receipt of a letter from the Petitioner notifying it of the Petitioner’s claim of representation status. LAKE ROAD CONDOMINIUM AND SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 32E, AFL-CIO The employer asserted that a representation proceeding was barred because a contract was still effective between the employer and its sole employee, and that the proceeding was therefore barred. After finding that the contract was an individual contract with the employer, SERB held that the existence of individual employment contract is not a bar to the processing of a representation petition. MOUNT KISCO MIDDLE INCOME HOUSING CORP. AND WESTCHESTER PROPERTY MANAGEMENT GROUP, INC. AND SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 32E, AFL-CIO SERB accepted the recommendations and adopted the opinion in the intermediate report of the Administrative Law Judge (ALJ) concluding that the employer engaged in an unfair labor practice in violation of §§704.6 of the State Employment Relations Act (Act) by failing to commence negotiations. The evidence established that the employer never agreed to attend a negotiating session, although the union requested that it do so, and that the employer never accepted or rejected the union’s contract terms or made any proposals of its own. The employer’s defense of a claimed lack of understanding of the recognition process was rejected, as was the employer’s claim that the filing of a refusal to bargain charge relieved the employer of any further obligation to bargain. In its decision, SERB credited the building superintendent’s testimony that he was paid on a regular basis and found that the record established that the building superintendent was an employee under the Act. 300 LINDEN LLC AND LOCAL 32B-32J, SERVICE EMPLOYEES INTERNATIONAL UNION, AFL-CIO SERB dismissed, on jurisdictional grounds, a petition filed by the employer under §705 of the Act concerning a question of representation regarding a single person unit consisting of a building superintendent in an apartment building in Brooklyn. Under the jurisdictional standards of the National Labor Relations Board (NLRB), the NLRB will assert jurisdiction over apartment houses that receive at least $500,000 in gross revenue annually. Since the parties stipulated that the employer has received over $500,000 in gross revenues during the last 12 months, SERB found that the employer is subject to NLRB jurisdiction. Even though the NLRB, unlike SERB, does not entertain petitions where, as here, the bargaining unit consists of a single employee, the prohibition against SERB’s assertion of jurisdiction exists because States cannot contravene federal labor policy. ST. AGATHA’S ROMAN CATHOLIC CHURCH SOCIETY AND DIOCESAN ELEMENTARY TEACHERS ASSOCIATION SERB found, based on the union’s own formal, written acknowledgment, that it no longer represents a majority of employees in the appropriate unit. Therefore, based on the union’s own admission, SERB found that the employer is under no duty currently to recognize or bargain collectively with the union and, conversely, the union is no longer entitled to those rights reserved to representatives selected by a majority of the employees under the Act. CATHOLIC HIGH SCHOOL ASSOCIATION AND LAY FACULTY ASSOCIATION, LOCAL 255, L.I.U.N.A. SERB denied exceptions filed by the employer to an intermediate report issued by an Administrative Law Judge (ALJ) finding that the employer had engaged in unfair labor practices in violation of §704(6) of the State Employment Relations Act (Act), but had not engaged in unfair labor practices in violation of §§704(5) and (10) of the Act. SERB accepted the recommendations and adopted the opinion of the ALJ finding that the totality of the employer’s conduct constituted an unlawful refusal to bargain. However, SERB modified the ALJ’s finding that the refusal to bargain commenced on May 22, 2001. Instead, SERB found that the refusal to bargain commenced on or about August 1, 2001 because a provision in the collective bargaining agreement insulated the employer from any finding of unlawful refusal to bargain prior to August 1, 2001 and the employer had not waived this contractual protection by entering into negotiations at an earlier time. 334 EASTERN PARKWAY REALTY LLC AND LOCAL 32BJ, SERVICE EMPLOYEES INTERNATIONAL UNION, AFL-CIO SERB dismissed, on jurisdictional grounds, a petition filed by the employer concerning a question of representation regarding a single person unit consisting of a building superintendent at an apartment building in Brooklyn. Although SERB found that the apartment building alone would not be subject to NLRB jurisdiction as it falls just below that standard, SERB concluded that the managing agent for the building is a joint employer who manages at least ten other properties that far exceed the NLRB’s jurisdictional standards. 334 EASTERN PARKWAY REALTY LLC AND LOCAL 32BJ, SERVICE EMPLOYEES INTERNATIONAL UNION, AFL-CIO SERB denied the employer’s motion for reconsideration of a prior decision dismissing its petition for lack of jurisdiction. The employer asserted that the record was insufficient to support SERB’s jurisdictional finding. However, SERB reiterated that the prior testimony of the management employee concerning the size and number of buildings managed by the employer made it overwhelmingly clear that, whatever the total amount of the employer’s annual revenue, it exceeded the NLRB’s monetary jurisdictional standards. BONAVENTURE SCHOOL AND DIOCESAN ELEMENTARY TEACHERS ASSOCIATION SERB terminated its investigation on the employer’s decertification petition by adopting the certified bargaining agent’s admission that it did not represent a majority of the employees in the appropriate bargaining unit.
