Some 2025 numbers:
--- For the approximately eleven-month period starting June 12, 2024 (with the new Chair) to May 16, 2025, the Board has issued 51 decisions. By comparison, the Board issued 21 decisions in calendar year 2023. This is a 143% increase in the issuance of Board decisions for this eleven-month period compared to the prior year.
--- During the same period, there were 104 ALJ/HO/Director decisions issued. There were 83 ALJ/HO/Director decisions in calendar year 2023. This is a 25% increase in the issuance of ALJ/HO/Director decisions in this eleven-month period compared to the prior year.
--- As of April 29, 2025, there were 21 ALJ/HO/Director decisions that had not been issued within 90 days of the submittal of closing briefs. As of July 31, 2024, there had been 42. This is a 50% decrease in “older” ALJ/HO/Director decisions over this approximately nine-month period.
PERB Training:
PERB is planning to provide a half-day training about PERB practices and procedures to new advocates and refresher training to experienced advocates at various locations around the State. The first such training will be offered in Albany in late October/early November. Further details will be announced shortly.
Services Previously Offered by FMCS:
With the staff of the Federal Mediation and Conciliation Service being, we are told, reduced from 160 mediators to 6 nationwide, PERB’s Office of Conciliation will now offer mediation services in private sector strike situations and other collective bargaining negotiations, subject to staffing and budgeting capacity. Interested parties should contact our Office of Conciliation at 518-457-2690.
Staffing:
PERB will be adding additional ALJs to each of our Brooklyn, Albany and Buffalo offices.
Input and Outreach:
In the last few months, senior PERB staff have met with the California Agricultural Labor Relations Board, the AFL-CIO Public Sector Task Force, the United Farm Workers, and the AFL-CIO farm laborer unions. A second meeting with the Farm Bureau and farm employer representatives is in the process of being scheduled. Additionally, PERB staff have made presentations to the New York State United Teachers, Long Island Labor Employment Relations Association, and New York State Professional Firefighters Association. A presentation is currently scheduled for the New York State Public Employer Labor Relations Association for later this summer.
