Direct Entry Improper Practice
Overview: Here's how to file and Improper Practice Charge against Employers or Employee Organizations in the public sector.
Before you File:
- Review the portions of the Taylor Law and PERB’s corresponding Rules of Procedure related to improper practices.
- If you are an individual representing yourself, review PERB’s Guide for Individuals Filing an Improper Practice Charge on Their Own Behalf.
- Improper practice charges must be filed within 4 months of when the filer knew or should have known of the alleged improper practice.
How to File:
- Complete both pages of the Direct Entry Improper Practice form below.
- File a copy of the Charge with the Director of Public Employment Practices and Representation at [email protected].
- Once the unfair labor practice charge is filed and deemed sufficient, you will receive a Notice of Conference letter which includes the case number and a date for a pre-hearing conference.
Notice of Appearance
Overview: The purpose of this form is to enter a Notice of Appearance for a pending, public sector case before the NYS Public Employment Relations Board (PERB).
How to File:
- Complete the Notice of Appearance form below.
- Email the completed form to the Director of Public Employment Practices and Representation at [email protected].
Withdrawal Request
Overview: The purpose of this form is to request to withdraw a pending, public sector case before the NYS Public Employment Relations Board (PERB).
How to File:
- Complete the Withdrawal Request form below.
- Email the completed form to the Director of Public Employment Practices and Representation at [email protected].
Transcript Cost Waiver Application
Overview: The purpose of this form is to apply to have the costs of the transcript(s) in your case waived.
How to File:
- Complete the Transcript Cost Waiver Application form below.
- Email the completed form to the Deputy Chair at [email protected].
