Direct Entry Improper Practice
Overview: Here's how to file and Improper Practice Charge against Employers or Employee Organizations in the public sector.
Before you File:
- Review the portions of the Taylor Law and PERB’s corresponding Rules of Procedure related to improper practices.
- If you are an individual representing yourself, review PERB’s Guide for Individuals Filing an Improper Practice Charge on Their Own Behalf.
- Improper practice charges must be filed within 4 months of when the filer knew or should have known of the alleged improper practice.
How to File:
- Complete both pages of the Direct Entry Improper Practice form below.
- File an original and four copies of the Charge with the Director of Public Employment Practices and Representation and mail to: NYS Public Employment Relations Board, PO Box 2074, ESP Agency Building 2, Floor 18, Albany, NY 12220-0074.
- Once the unfair labor practice charge is filed and deemed sufficient, you will receive a Notice of Conference letter which includes the case number and a date for a pre-hearing conference.
Withdrawal Request
Overview: The purpose of this form is to request to withdraw a pending, public sector case before the NYS Public Employment Relations Board (PERB).
How to File:
- Complete the Withdrawal Request form below.
- Mail the completed form to the Director of Public Employment Practices and Representation, NYS Public Employment Relations Board, PO Box 2074, ESP Agency Building 2, Floor 18, Albany, NY 12220-0074.
