Direct Entry Declaration of Impasse
Overview: Filing a Declaration of Impasse is the first step in the process for resolution of disputes in the course of collective negotiations under the Taylor Law for public sector employers and employee organizations.
If the Director of Conciliation determines that an impasse exists, they shall appoint a mediator from a list of qualified persons maintained by PERB.
Before you file:
- Review the portions of the Taylor Law and PERB’s Rules of Procedure governing impasse for public sector employers and employee organizations.
- Complete the form provided at PERB’s website entitled Declaration of Impasse.
How to file:
- Complete Declaration of Impasse (Public Sector) form below.
- Email the completed Declaration of Impasse to the Director of Conciliation at [email protected] and simultaneously serve one copy upon the respondent to the Respondent’s email address.
- Please do not send a hard copy to PERB’s mailing address.
Direct Entry Demand for Arbitration
Overview: This form allows allow parties in public sector to enter into collective bargaining agreements, adopting grievance arbitration as the manner of resolving contract related disputes. The parties agree to the procedures to be used. Many employers and employee organizations elect to use PERB’s services to select an arbitrator.
Before you File:
- Review the portions of the Taylor Law Rules of Procedure.
- See Part 207 of the Taylor Law Rules of Procedure for public sector employers and employee organizations.
How to File:
- Complete the Demand for Arbitration (Public & Private Sector) form below.
- Email the completed form to PERB’s Office of Conciliation at [email protected].
- Simultaneously serve one copy to the Employer’s representative’s email address (or Employee Organization representative’s email address, if filed by the Employer).
- Please do not send a hard copy to PERB’s mailing address.
- After processing, an invoice for the $50 filing fee will be sent to the parties.
Joint Submission to Arbitrate
Overview: If both parties to the collective bargaining agreement are requesting arbitration, the parties may submit a Joint Submission to Arbitrate.
How to File:
- Complete the Joint Submission to Arbitrate form below.
- Retain one copy for each party and submit the form via email to PERB’s Office of Conciliation at [email protected] and to the other party via email.
- Please do not send a hard copy to PERB’s physical mailing address.
- After processing, invoices for the $50 filing fee will be sent to the parties.
Staff Grievance Mediation/Arbitration
Overview: Parties in the public sector may use this form to request that a full-time member of PERB’s professional staff serve as both mediator and, if necessary, arbitrator of the issue(s) in dispute.
How to File:
- Complete the Joint Request for Staff Grievance/Arbitration form below.
- Retain one copy for each party and submit the form via email to PERB’s Office of Conciliation at [email protected].
- Please do not send a hard copy to PERB’s physical mailing address.
- After processing, invoices for the $50 filing fee will be sent to the parties.
